NOTICE INVITING TENDER
1.0 Sealed item rate tenders in two bid system for the under mentioned work of Construction of Vocational Training Institute and Working Women’s Hostel at Dwarka sector-10, New Delhi, are invited from the contractors of repute who fulfill the following conditions. The tender is to be submitted in two different envelops, seperately for technical and financial bids upto 3.00 PM on 04/06/2012. The technical bid duly accompanied with earnest money shall be opened on the same day at 3.30 PM.

2.2 Earnest Money amounting to Rs. 25.00 Lakhs
The amount not less than 50% of the earnest money i.e Rs 12.50 lakhs in the form of Deposit at call receipt or fixed deposit receipt / demand draft, (valid for a period of not less than four months), issued in favour of YWCA OF DELHI shall be deposited at the time of submission of tender documents. Balance earnest money for Rs 12.50 lakhs is acceptable in the form of Bank Guarantee.
2.3 Eligibility Criteria
(a) The contractors who have successfully completed similar works amounting as under, during last 5 years ending 30.04.2012.
i) Three similar works costing not less than the amount equal to 40% of the estimated cost put to tender.
or
ii Two similar works costing not less than the amount equal to 50% of the estimated cost put to tender.
or
iii) One similar work costing not less than the amount equal to 80% of the estimated cost put to tender
(b) Average annual financial turnover on the construction works should be at least 60% of the estimated cost of the work during the last 3 years ending 31st March 2012. (Duly audited by chartered accountant.)
(c) Should have a bank solvency of the amount equal to 40% of the estimated cost of work. The solvency certificate should have been issued by the bank during past six months from the date of submission of the tender.
(d) Should not have incurred any loss in more than 2 years during the last 5 years ending March 31, 2012.
(e) The cost of respective works completed by a contractor shall be suitably enhanced @ 5% for each subsequent year following the financial year in which that particular work had been completed to bring it at par with the present cost. Enhancement on similar lines shall also be effected in respect of turn over of the contractor.
(f) Should have a valid certificate of Registration under Delhi Value added tax act 2004 with works contract cell of sales tax / VAT department of GNCTD. The Tax Clearance Certificate issued by the said cell before the tender paper can be sold to him.
2.4 The Technical bid duly supported by prescribed annexure(s) and the Financial bid duly filled with all the item rates in two separate sealed envelopes duly marked "Technical Bid with supporting Documents" and "Financial Bid" should be submitted up to 3PM on 04.06.2012 in the office of General Secretary YWCA of Delhi, Ashoka Road, New Delhi 110001.
2.5 The financial bid of only those contractors shall be opened who qualify the technical evaluation on the date and time, which shall be intimated to them.
2.6 Financial bid shall remain valid for a period of 90 days from the date of it's opening.
2.7 Tender documents along with drawings can be obtained on payment of Rs. 5000/- on any working day from 14/05/12 to 01/06/2012 between 2 PM to 4.30 PM in cash (non refundable) from the office of General Secretary YWCA OF DELHI, Ashoka Road, New Delhi-110001, on production of certificate of registration under Delhi Value Added Tax Act 2004 with Works Contract Cell of Sales Tax/ VAT Department of GNCTD along with Tax Clearance Certificate of the same.
2.8 If any information furnished by the applicant is found incorrect at a later stage, he shall be liable for appropriate legal action against him including termination of contract. YWCA of Delhi reserves the right to verify the particulars furnished by the applicant independently including carrying out inspection of works completed by the applicant bidder.
2.9 The contractor whose tender is accepted shall be required to furnish by way Performance Guarantee/ Security deposit, for due fulfillment of his contract. The security deposit will be deducted from the running account/ final bill of contractor at the following rate:
a) Performance Guarantee @ 5% (five percent) of the tendered amount for the proper performance of the contract agreement within fifteen days of issue of letter of intent. This period can be further extended by the General Secretary YWCA OF DELHI, up to a maximum period of seven days on written request of the contractor. This guarantee shall be in the form of Fixed Deposit Receipt or Guarantee Bond of any reputed Bank in accordance with the form annexed hereto.
b) Security Deposit @ 5% (five percent) of the tendered value of the work by way of deduction from the running bills of the contractor @ 10% (ten percent) of gross amount of each running bill till the sum along with the sum already deposited as earnest money amounts to 5% of the tendered value of the work.
2.10 The competent authority on behalf of YWCA OF DELHI does not bind himself to accept the lowest tender and reserve to himself the authority to reject any or all the tenders received without assigning any reason.
2.11 Convassing in connection with tenders is strictly prohibited and the tender submitted by the Contractor who resort to canvassing shall be liable to rejection.
2.12 This is item rate tender, the tendered rate containing percentage below /above will be summarily rejected.
a) It may please be carefully noted that no condition, whatsoever, shall be accepted by the YWCA OF DELHI and the contractor is strictly prohibited from giving conditional tender and if any contractor is not prepared to execute the work at the terms and conditions contained in the tender documents, he is requested not to tender for this work. It may be noted that if any contractor chooses to submit conditional tender in spite of clear direction given above, his tender is liable to be summarily rejected and his full Earnest Money shall stand forfeited.
b) Monthly R/A bills will be submitted by the contractor when minimum gross amount of the work done since the previous months is more than Rs 50,00,000/- (fifty lakhs).
2.13 On acceptance of the tender the name of the authorized representative of the contractor who would be responsible for taking instructions from the authorized representative of YWCA shall be communicated to the General Secretary YWCA of Delhi within seven days of the letter of intent or before taking over possession of the site, whichever is earlier.
2.14 YWCA OF DELHI reserves the right to itself for accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rates quoted by them.
2.15 Sales tax/ VAT or any other tax on materials in respect of this contract shall be payable by the contractor and YWCA OF DELHI will not entertain any claim whatsoever in this respect.
Service tax wherever applicable shall however, be reimbursed to the contractor on production of proof of payment to the concerned department.
2.16 Contractor must produce certificate of registration under Delhi Value Added Tax Act 2004 with Works Contract Cell of Sales Tax/ VAT Department of GNCTD along with Income Tax Clearance Certificate thereof before the tender papers can be sold to him.
(a) Labour CESS: Cess under the provision of Building and Other Construction Workers (RE & CS) Act 1996 and the Building and Other Construction Workers Welfare CESS Act 1996 @ 1% of the cost of Construction/Project shall be deducted at source from the bill paid to the Contractor. YWCA OF DELHI shall not bear any liability on account of CESS being deducted and reimbursed to GNCTD in pursuance of Building and Other Construction Workers Welfare CESS Act, 1996 read with Delhi Building and Other Construction Workers (RE. & CS.) Rules, 2002.
(b) Income Tax: @ 2% of total payment will be deducted by the owner at source.
2.17 The tender for work shall remain open for acceptance for a period of ninety days from the date of opening of Financial Bid. If any, tenderer withdraws his tender before the said period or issue of letter of acceptance, whichever is earlier, or makes any modifications in the terms and conditions of the tender which are not acceptable, then the YWCA OF DELHI shall without prejudice to any other right or remedy, be at liberty to forfeit 50% of the said earnest money as aforesaid.
2.18 The contractor shall submit the list of work which are in hand (progress) in the Performa given below:

2.19 The tenderer shall be provided with the drawings in respect of all sub heads/ sections of work along with the tender document including BOQ which should be seen by the contractor care fully before tendering the rates.
2.20 With-drawl of tender offer shall not be permitted in any manner. In case the contractor(s) intend to do so, following action shall be taken by the YWCA OF DELHI against him.

ii) If the contractor withdraw his offer immediately after the award of work The earnest money deposited by the contractor shall be forfeited absolutely.
(iii) If the contractor/ agency withdraw his offer after award of the work and taking over possession of site. It is deemed that the contractor has entered into contract and action to penalize the contractor, for not completing the work within the stipulated period will be taken against the contractor, if he abandons the site after taking over the possession of the site. For taking such action, the only documentary proof required will be the document showing signature of the contractor or his authorized representative for taking over the possession of site. It is further clarified that such action would also be attracted even though the Contractor fails to sign the agreement on Rs.50/- non-judicial stamp paper but does not start work on or before the date of start. The date of start of the work will be considered as date of taking over the possession of site or the tenth day after written order to start the work which ever is earlier.
2.21 No labor hutments shall be allowed to be provided by the contractor at site of work i.e. within the premises of YWCA of Delhi.
2.22 The contractor, at his own cost and expenses, shall comply with all the current applicable labor laws and statutory provisions and keep the Owner indemnified thereof. All liabilities in respect of the labor will be the sole responsibility of contractor. No compensation and/ or any claim what so ever in this regard shall be entertained by the YWCA of Delhi.
2.23 No labor below the age of 18 years shall be employed on the work. The contractor shall pay equal wages to both men and women in accordance with the applicable labor laws.

(iii) Fire Fighting provisions and Pumps thereof
(iv) Electrical Works including providing and commissioning of Motors etc.
3.5. Work shall be executed according to CPWD Specifications/ IS Codes and other specifications as mentioned in General/ Special Conditions/ specifications contained in the Tender Document
3.6. Extent of Site: As per the site plan attached with the Tender Document.
3.7. Existing Conditions Site & Surroundings: To be verified by the Contractor.
3.8. Nature of Soil: As per existing site conditions.

Notice Inviting Tenders for Supplier for Stationery Items
YWCA of Delhi intends to prepare of panel of vendors for regular supply of various stationery items during the current finacial year. Interested parties may submit their quotations.
